السياسة الشرعية وكيفية العمل بها

Abstract

الحمد لله رب العالمين ، والصلاة والسلام على المبعوث رحمة للعالمين ، نبينا محمد  وعلى آله وصحبه والتابعين ومن تبعهم بإحسان إلى يوم الدين . وبعد : فإنَّ موضوع السياسة الشرعية مـــــــــــــــــــــــن أهم الموضوعات في الحياة بشكــــــــــــــــــل عام ، لا بل هو من أخطر الموضوعات في فقهنا الإسلامي العتيد ، وأخطر من ذلك كله أنْ يتعلق هذا الموضوع بـ (السياسة الشرعية وكيفية العمل بها) ذلك لأنَّ المتبادر إلى الأذهان أنَّ مجال السياسة الشرعية وميدانها هو في حدود ما لا نص فيه والحكم الشرعي منصوص عليه بالضرورة . وإنَّ الأدلة على كون السياسة الشرعية من الإسلام كثيرة جداً ، وأنَّ كيفية العمل بها والأخذ بأحكامها من مسلّمات الفكر الإسلامي ، غير أنَّ الفكرة السائدة في هذا الزمان أنَّ الدين لا دخل له في السياسة ، كما أنَّ السياسة لا دخل لها في الدين وأصبحت اللادينية عقيدة تعتنقها فئات عريضة من المسلمين وانتشر هذا الفكر وأخذ أصحابه يطالبون بعزل الدين عن الدولة حتى أصبح الدين في نظرهم لا يخرج عن نطاق العبادات فقط ، وهم بذلك أهملوا جانباً مهماً من جوانب الفقه ألا وهو الفقه السياسي أو فقه السياسة الشرعية . ومن أجل ذلك ، كان لزاماً علينا إيراد بعض تلك الأدلة التي تجعل العمل بالسياسة الشرعية أمراً قطعياً لازماً لاستقامة الحياة وتحقيق مصالح العباد ، وإقامة نظام العدل في الأمة على وفق مقتضيات الشريعة . Praise be to God, Lord of the worlds, and prayers and peace be upon the one who was sent as a mercy to the worlds, our Prophet Muhammad, peace be upon him, and his family, companions, followers and those who followed them in goodness until the Day of Judgment. And after: The issue of Shari’a politics is one of the most important topics in life in general, rather it is one of the most dangerous topics in our future Islamic jurisprudence, and the most dangerous of all that this topic relates to (legal politics and how to work with it) because what comes to mind is that the field and field of legitimate politics is Within the limits of what is not stipulated and the legal ruling is necessarily stipulated. The evidence for the fact that legal politics is part of Islam is very numerous, and that how to act upon it and adopt its rulings is a postulate of Islamic thought. However, the prevailing idea in this time is that religion has nothing to do with politics, just as politics has nothing to do with religion and irreligiousness has become a belief espoused by groups. A petition from Muslims and this thought spread and its companions demanded the isolation of religion from the state until religion became in their view not outside the scope of worship only, and thus they neglected an important aspect of jurisprudence, which is political jurisprudence or the jurisprudence of legitimate politics. And for that, it was necessary for us to include some of those evidences that make the work of the legal policy absolutely necessary for the straightening of life and the realization of the interests of the people, and the establishment of the justice system in the nation in accordance with the requirements of the Sharia. Accordingly, the research was divided into an introduction and five chapters: The first topic: Defining the legal policy, linguistically and idiomatically. The second topic: How to derive the rulings of Sharia policy. The third topic: Evidence for the authenticity of legal policy. The fourth topic: Examples of the rightly-guided caliphs’ work on legal politics. The fifth topic: a balance between legitimate politics and positive politics.
