تبادل الادوار بين المجني عليه والجاني فقهياً

Abstract

الحمد لله والصلاة والسلام على رسول الله , وعلى اله واصحابه ومن والاه . وبعد ان التركيز من قبل الفقهاء على فعل المجنى عليه ليس كالتركيز على فعل الجاني وذلك لان المتبادر الى الاذهان ان الجاني اما هو المعتدي القاصد للجريمة فتكون عمدا او غير القاصد لها فتكون خطا او شبه عمد...... كما ان الاثار المترتبة على الجاني عند ارتكابه للجريمة واضحة والعقوبات التي تقع عليه اما حدية او تعزيرية وكلا حسب حجم الجريمة او الجناية التي تنفذ من قبل القاضي حرصا على ارواح واعراض المجنى عليهم. فالجرائم والجنايات يلزم لان تسمى او تصبح واقعا ان يوجد الجاني او المجني عليه كما هو المتعارف عليه في العقود فهي لاتمضي الا بتوفير ركني الايجاب والقبول وبانعدامهما او احدهما لاينعقد العقد الا ان الفارق دائما المجنى عليه هو فاقد لعنصر القبول او الرضا بالاعتداء عليه ولو عكسنا المسالة بتصور وجود الجناية او الجريمة بقبول او رضا او اذن المجنى عليه للجاني وهنا ان شاء الله سنتكلم عن هذا المضمون رضا او اذن المجنى عليه والاثر الذي يترتب عليه وقد قسمت البحث الى مباحث . نتعرف من خلالها على ماهية البحث بعون الله. المبحث الاول : التعريف بمصطلحات البحث المطلب الاول: معنى الاذن والالفاظ ذات الصلة المطلب الثاني: الجناية والتعزير لغة واصطلاحا. المبحث الثاني: اثر اذن المجنى عليه في الجنايات وجرائم الحدود والتعازير المبحث الثالث: اثر اذن المريض للطبيب او غيره في قتله . المبحث الرابع : اثر اذن اللاعب في الالعاب الرياضية. المبحث الخامس: اثر اذن الزوجة للزوج للحق في التاديب .
