العمل بشهادة القلب والترجيح بها دراسة أصولية

Abstract

البحث بعنوان (العمل بشهادة القلب والترجيح بها، دراسة أصولية) تناولت في المبحث الأول بيان مفهوم شهادة القلب ، والألفاظ ذات الصلة به ، كما بينت ، حجيته كأصل من أصول التشريع عند الأصوليين من مذهب الأحناف ، مضيفا إلى بيان علاقته بالفطرة ، ثم ذكرت أهم الضوابط لقبول شهادة القلب ، والاعتداد بها ، وأمّا الثاني فقد جعلته في مطلبين ، ذكرت استعمال شهادة القلب في الاستدلال ، وذلك من خلال الترجيح بين قياسين متعارضين ، فلا سبيل له إلا الترجيح بشهادة القلب عند الحنفية ،وفي المطلب الثاني تناولت الترجيح بين أقوال الفقهاء من خلاله لمن لم يبلغ درجة الاجتهاد. The research entitled (Working with heart testimony and its effect on weighting) in the first section dealt with a statement of the concept of heart testimony, and the related expressions, as I showed, its authority as an origin of the principles of legislation for the fundamentalists of the Hanafis doctrine, adding to a statement of its relationship to the instinct, then I mentioned the most important controls for accepting testimony As for the second one, I made it two demands, I mentioned the use of the heart’s testimony in inference, by weighting between two opposing measurements, so there is no way for him except by weighting the testimony of the heart by the tap, and in the second requirement I dealt with the weighting between the sayings of the jurists through it for those who did not reach The degree of diligence.
